Refund and Cancellation Terms

1. Scope

These Terms govern the refund of funds paid by the client (the "Client") to the company (the "Contractor") for services rendered under a paid services agreement: consultation, foreign real estate selection, deal support, and representation of the Client's interests during purchase. These Terms do not cover refunds for the properties themselves — such matters are governed by the sale-purchase agreement between the Client and the seller (developer, owner, foreign agency).

2. Types of services

Initial consultation. Remote call up to 45 minutes, including discussion of the Client's goal, market overview, and preliminary recommendations. Free and not refundable (no fee charged).

Selection. A personalised shortlist of 15–25 properties matching the Client's criteria, with yield calculations, specifications, and legal status. Cost: 1,500–3,000 USD deposit, credited against the final fee upon deal completion.

Legal Due Diligence. Review of title documents, ownership registry, developer permits, sale-purchase agreement. Cost: 500–1,500 USD depending on country and complexity.

Transaction Support. Coordination of SPA signing, escrow, payments, representation of the Client's interests at local authorities. Cost: 2–3% of property price, less the earlier deposit.

Post-sale service. Utility setup, management company contract, tax support. Cost: 1,500–3,000 USD per year, billed separately.

3. Refund by stage

3.1. Selection deposit.

  • Cancellation before the first shortlist — 100% refund less bank transfer fees.
  • After shortlist but before viewings — 50% refund.
  • After viewings — 20% refund; 80% retained as compensation for actual costs.
  • After legal due diligence has begun on a specific property — no refund.

3.2. Legal due diligence fee.

  • Not started — 100% refund.
  • Started but not completed — 50% refund.
  • Completed and report delivered — no refund.

3.3. Transaction support fee.

  • Cancellation before SPA signing — 70% refund pro rata to unperformed work.
  • After SPA signing — no refund; the fee covers representation until title registration, and services are rendered in full.

3.4. Post-sale service.

  • Upon early termination, refund is pro rata to the unused term, less actual costs and one-off setup work.

4. Refund procedure

To claim a refund, the Client sends a written request to the Contractor's official email specifying: contract reference, refund amount, bank details. The Contractor reviews the request within 10 business days and, absent objections, transfers funds within 15 business days of confirmation.

5. Non-refundable cases

Refunds are not made if: - the deal is successfully completed and the property is registered in the Client's name; - the Client's cancellation is due to a change in their financial circumstances but the Contractor's services have been rendered in full; - the Client failed to provide required documents, making continued work impossible; - the cancellation is received later than 30 calendar days after the final fee invoice was issued.

6. Force majeure

Under force majeure (sanctions, currency-control restrictions, developer bankruptcy, legislative changes making the deal impossible), the parties act by individual agreement. By default the Contractor refunds the unperformed portion of the deposit less actual costs.

7. Dispute resolution

All disputes are resolved through negotiation. Failing that — in court under the laws of the Russian Federation at the Contractor's location.
